What to Do if You Are Falsely Accused of a Sex Crime

Arrested4

The MeToo movement and similar campaigns that have arisen in the past year or so have allowed many victims to come forward and seek justice. Unfortunately, they have also sparked many false accusations against men and women alike that have never committed a sex crime and now, they face some of the most serious consequences in the criminal justice system. It is for this reason that anyone that has been accused of a sex crime should speak to a Florida criminal defense lawyer as soon as possible. They should also know the steps they should take immediately after being falsely accused.

Understand the Consequences of a Conviction

Many people falsely accused of a sex crime do not think the situation is that serious. Knowing that they are innocent, they sometimes think there is no way they can be convicted, and the people around them may even be saying that the other side does not have a case. However, it is crucial that you understand the seriousness of the situation. Sex crimes are some of the worst offenses in Florida and, if you are being accused of a sex crime against a child, the consequences are even more severe. Make sure you research the legal ramifications of the charges against you and start building your defense.

Create a Timeline

It is crucial to your case to create a timeline of everything you did on the date and time the alleged sex crime took place. Start at the day or the day before the alleged crime and create a complete timeline that extends to the current day. This will show what you were doing before, during, and after the alleged crime.  This could be one of the most valuable pieces of information you have for your defense, particularly if you have an alibi.

Say as Little as Possible

Sometimes, people that have been falsely accused of a crime, such as sexual battery, become their own worst enemy. They may want to talk to their accuser, or they may make a comment that is taken out of context and very hurtful to their case. When facing false accusations, it is best to say as little as possible, especially about the accusations. Also, certainly do not speak to the person that is making the accusations. That is one of the worst things you can do, as they will likely use it against you and things can become very heated, which will only make things worse for your case.
